ORDER


Plaintiff's Rule 56.1 Statement fails to comply with the rule in that it fails to respond to each paragraph of movant's Rule 56.1 Statement by stating whether plaintiff acknowledges that the assertion of the relevant paragraph is undisputed, as alleged by movant, or whether plaintiff contends that there is a genuine issue of material fact with respect to the assertion, citing admissible evidence in the record supporting plaintiff's contention that there is a genuine issue of material fact. Accordingly, the Rule 56.1 Statement is stricken.

Plaintiff shall submit any amended Rule 56.1 Statement on or before August 26, 2002.

SO ORDERED.
