SHEILA SHANAHAN, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent
ORDER
PETER J. PANUTHOS SPECIAL TRIAL JUDGE.
On April 1, 2024, the parties filed a Proposed Stipulated Decision (Entry No. 50) in this case. Upon review, it appears that the document references a stipulation not filed therewith.
When this case was called from the calendar at the Court's April 2, 2024, San Francisco, California, trial session, there was no appearance by petitioner. Respondent's counsel appeared and advised that the parties had filed a Proposed Stipulated Decision on April 1, 2024. The Court acknowledged receipt of the filing, noted the error therein, and directed the submission of a new settlement document by May 2, 2024. To date, no such submission has been received. Upon due consideration and for cause more fully appearing in the transcript of the proceeding, it is
ORDERED that the Proposed Stipulated Decision, filed April 1, 2024, at Entry No. 50, is hereby deemed stricken from the record in this case. It is further
ORDERED that the parties shall file a status report (joint or separate) on or before July 5, 2024, and advise as to (1) what action, if any, the parties have taken to correct the settlement document previously submitted and (2) explain why the parties have not communicated with the Court as directed at the April 2, 2024 hearing to correct errors made in documents.
