ORDER

Ronald L. Buch, Judge.

This case is calendared for trial at the Court's December 6, 2021, New Orleans, Louisiana remote trial session. On August 24, 2021, the Commissioner filed a Motion to Dismiss for Failure to Properly Prosecute, and on September 28, 2022, the Court held a conference call with the parties to discuss the motion and the status of the case. Since that time, counsel has entered an appearance for Shamrock, filed a status report, and informed the Court that he had contacted the Commissioner, discussed the issues in this case, and will be providing documentation to the Commissioner. The case remains pending on the December 6, 2021, New Orleans, Louisiana remote trial session. With the understanding that the parties are working toward resolution of this case, it is

ORDERED that the Commissioner's motion to dismiss for failure to properly prosecute, filed August 24, 2021, is denied without prejudice.
