BILAWAL SHAHZADA, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 195th Judicial District Court Dallas County, Texas
Trial Court Cause No. F16-59528-N

ORDER

We REINSTATE this appeal.

On December 29, 2018, we denied appellant's fourth motion to extend time to file his brief and abated this appeal for the trial court to conduct a hearing to determine why appellant's brief has not been filed. On January 31, 2018, the trial court filed its findings. We ADOPT the trial court's findings that (1) appellant desires to prosecute the appeal; (2) appellant is indigent and represented by appointed counsel Christian Souza; and (3) Mr. Souza informed the trial court that he has not filed a brief because of his "heavy appellate docket workload."

We ORDER appellant's brief filed BY MARCH 2, 2018. If appellant's brief is not filed by 5:00 p.m. March 2, 2018, the Court will, absent exigent circumstances, enter an order removing Mr. Souza as appointed counsel and ordering the trial court to appoint new counsel to represent appellant.
