By Notice served December 27, 2023, this case was calendared for trial on the Court's San Diego, California trial calendar which commenced on April 15, 2024. On March 22, 2024, respondent filed a Motion to Dismiss for Lack of Prosecution.

On April 15, 2024, this case was called from the calendar at the Trial Session of the Court in San Diego, California. There was no appearance by or on behalf of the petitioner. Counsel for respondent appeared and was heard. At that time respondent informed the Court that the parties had reached a basis for settlement and that respondent requests more time to file a signed decision document.

Upon due consideration and for cause more fully appearing in the transcript of the proceedings, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution filed March 22, 2024, is denied as moot. It is further

ORDERED that, on or before May 15, 2024, the parties shall submit to the Court either a stipulated decision or file a joint report (or separate reports, if preferred) regarding the then-present status of this case. It is further

ORDERED that this case is continued. It is further

ORDERED that jurisdiction is retained by the undersigned.
