Sesler v. State

District Court of Appeal of Florida, Fifth District
Apr 17, 1998
707 So. 2d 1211 (Fla. Dist. Ct. App. 1998)

Opinion

No. 97-1561.

Opinion filed April 17, 1998. JANUARY TERM 1998.

Appeal from the Circuit Court for Sumter County, John W. Booth, Judge.

James B. Gibson, Public Defender, and M. A. Lucas, Assistant Public Defender, Daytona Beach, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Allison Leigh Morris, Assistant Attorney General, Daytona Beach, for Appellee.

The appellant challenges the jurisdiction of the trial court to enter an order of restitution on November 16, 1995, some two and one-half months after imposition of sentence on August 31, 1995. The state concedes error. Accordingly, we quash the order of restitution.

ORDER QUASHED.

COBB, THOMPSON and ANTOON, JJ., concur.
