DECISION AND ORDER ON MOTION (Claim No. 122759.)

Motion for permission to proceed as a poor person and for extension of time to perfect appeal.

Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is

ORDERED that the motion for permission to proceed as a poor person is granted, without costs, only to the extent that the filing fees required by CPLR 8022 are waived. Pursuant to section 1250.9 (a) of the Practice Rules of the Appellate Division, the appeal may be perfected upon an original and five copies of a reproduced full record and an original and five copies of appellant's brief, or one copy of the complete record on appeal and an original and five copies of appellant's brief and appendix. It is further

ORDERED that the motion for an extension of time to perfect the appeal is granted, without costs, the dismissal of the appeal is vacated (see 22 NYCRR 1250.10 [c]), and the time to perfect the appeal is extended to March 29, 2019. No further extensions of time will be granted absent an unanticipated and extraordinary excuse for the delay.
