ORDER OF SUPERVISED RELEASE
On July 22, 2002, this Court entered an Order granting Petitioner Donald Seretse-Khama's Motion for a Preliminary Injunction. Pursuant thereto, it is hereby
ORDERED that as a condition of Mr. Seretse-Khama's release, he shall be required to post a bond in the amount of $2,500.00. Within 24 hours of posting the bond, Mr. Seretse-Khama shall be released from detention at the Central Virginia Regional Jail in Orange, Virginia, where he is currently being held under the authority of the Immigration and Naturalization Service (INS); and it is further
ORDERED as further conditions of Mr. Seretse-Khama's release:
(1) That Mr. Seretse-Khama appear in person at a time and place specified by INS, upon each and every request of the INS, for identification and for deportation or removal;
(2) That Mr. Seretse-Khama report in person to the Duty Deportation Officer, Detention and Removal, Washington District Office, 4420 N. Fairfax Drive, Room 426, Arlington, Virginia 22203, between the hours of 9:00 a.m. and 1:30 p.m., on each Thursday of each week for the first four weeks following his release, and thereafter on the 26th day of every month, unless he is granted permission to report on another date. If the reporting date should fall on a Saturday, Sunday, or a federal holiday, petitioner shall report on the next business day. If he is granted permission from Warren A. Lewis, District Director of the Washington District Office, to relocate to another state, he will be advised of the location to which he must report;
(3) That Mr. Seretse-Khama cannot travel outside of Washington, D.C. or the Commonwealth of Virginia for more than 48 hours without written notification to Mr. Lewis, District Director of the Washington District Office, 4420 N. Fairfax Drive, Arlington, Virginia 22203, of the dates and places of such proposed travel, and receipt of approval before such travel. Mr. Lewis agrees to respond expeditiously to any such request for approval of travel;
(4) That Mr. Seretse-Khama furnish written notice to Warren A. Lewis, District Director of the Washington District Office, 4420 N. Fairfax Drive, Arlington, Virginia 22203, of any change in residence or employment within 48 hours of such change;
(5) That Mr. Seretse-Khama assist the Immigration and Naturalization Service in obtaining any necessary travel documents; and
(6) That petitioner's failure to comply with these conditions of release may subject him to a fine, detention, or prosecution, subject to the approval of the Court; and it is further
ORDERED that within thirty days after his release, petitioner may apply for reemployment authorization from the INS pursuant to 8 C.F.R. § 241.13(h)(3), and the INS shall expeditiously process his application consistent with its other obligations.
