DECISION AND ORDER ON MOTION

Motion for extension of time to perfect appeals, for consolidation and for stay pending determination of appeals.

Cross motion to dismiss appeals for failure of prosecution.

Upon the papers filed in support of the motion and the cross motion and the papers filed in opposition thereto, it is

ORDERED that the motion for an extension of time to perfect the appeals is granted, without costs, and the time to perfect the appeals is extended to June 6, 2014, and it is further

ORDERED that the motion to consolidate is granted, without costs, to the extent that the appeals taken by notice of appeal dated October 28, 2013 from the order and judgment of Supreme Court dated August 28, 2013 and the notice of appeal dated July 16, 2013 from the order of Supreme Court dated June 13, 2013 shall be heard together with the appeals taken by notice of appeal dated July 16, 2013 from the order of Supreme Court dated June 3, 2013 and the notice of appeal dated December 7, 2012 from the order of Supreme Court dated October 31, 2012, and said appeals may be perfected upon a joint record on appeal and brief, and it is further

ORDERED that the motion for a stay pending determination of the appeals is denied, without costs, and it is further

ORDERED that the appeals are dismissed, without costs, unless appellant shall file and serve a record on appeal and brief on or before June 6, 2014, in which event the cross motion to dismiss is denied, without costs.
