Action to recover damages arising from the failure of defendant, the seller, to make delivery of certain shipments of iron fittings. Order denying plaintiff's motion for summary judgment and granting defendant's cross-motion for the same relief, and judgment entered thereon, unanimously affirmed, with ten dollars costs and disbursements. No opinion.
