In a mortgage foreclosure action, the plaintiff appeals from an order of the Supreme Court, Suffolk County, dated December 4, 1961, which granted the motion of the Polizzi defendants to enforce a stipulation of settlement entered into in open court during trial; declared said stipulation to be valid; directed the Clerk to enter judgment in accordance therewith; directed plaintiff's attorney, out of the sum of $5,000 held by him in escrow, to pay the sum of $400 to plaintiff and the sum of $4,600 to defendants in accordance with the stipulation; and directed that, upon such payments being made, the action is settled and discontinued. Order affirmed, with $10 costs and disbursements. No opinion. Ughetta, Acting P.J., Christ, Brennan, Hill and Rabin, JJ., concur.
