No. 2008 CA 2558.
December 30, 2009.
ON APPEAL FROM THE NINETEENTH JUDICIAL DISTRICT COURT NUMBER 548,382, DIV. E (23), PARISH OF EAST BATON ROUGE HONORABLE WILLIAM A. MORVANT, JUDGE.
Sera H. Russell, III, Lafayette, Louisiana, Counsel for Plaintiff-Appellant Anastasia Senegal.
Paul H. Spaht, Baton Rouge, Louisiana, Counsel for Defendants-Appellees Jarvis M. Antwine, individually and d/b/a the Law Office of Jarvis Antwine, and the Antwine Law Finn, L.L.C.
BEFORE: PARRO, KUHN, AND McDONALD, JJ.
Plaintiff-appellant, Anastasia Senegal, originally and as the natural tutor of her minor child, Kierany Shevlin, appeals the trial court's judgment, denying her motion for a continuance and granting the motion for summary judgment filed by defendants-appellees, Jarvis M. Antwine, individually and doing business as the Law Office of Jarvis Antwine, and the Antwine Law Firm, L.L.C. We find no abuse of discretion in the denial of the motion for continuance. See Denton v. Vidrine , 2006-0141, p. 11 (La. App. 1st Cir. 12/28/06), 951 So.2d 274, 284, writ denied , 2007-0172 (La. 5/18/07), 957 So.2d 152. And we find no error in the trial court's grant of summary judgment. See La.C.C.P. art. 966B; Uniform Rules of the District Courts, Rule 9.9; Buggage v. Volks Constructors, 2006-0175, p. 1 (La. 5/5/06), 928 So.2d 536. Defendants pointed out an absence of factual support for the causation element of her claim, and plaintiff failed to produce factual support sufficient to establish she will be able to satisfy her evidentiary burden of proof at trial. Thus, there is no genuine issue of material fact. See La.C.C.P. art. 966C(2); Costello v. Hardy , 2003-1146, p. 9 (La. 1/21/04), 864 So.2d 129, 138; Teague v. St. Paul Fire and Marine Ins. Co. , 2006-1266, p. 19 (La. App. 1st Cir. 4/7/09), 10 So.3d 806, 821, writ denied , 2009-1030 (La. 6/17/09), 10 So.3d 722. Accordingly, the trial court's judgment is affirmed in accordance with U.R.C.A. Rule 2-16.2A(2), (4), (5), (6), and (7). Appeal costs are assessed against plaintiff-appellant, Anastasia Senegal.
Because this court does not review evidence not properly admitted in the trial court, appellant's motion to supplement the record is denied. See Oil Ins. Ltd. v. Dow Chemical Co., 2007-0418, p. 4 n. 1 (La. App. 1st Cir. 11/2/07), 977 So.2d 18, 21 n. 1, writ denied, 2007-2319 (La. 2/22/08), 976 So.2d 1284.
