Andrew V. Sendejo Petitioner v. Commissioner of Internal Revenue Respondent

ORDER

Mark V. Holmes, Judge

This case is on the March 22, 2022 St. Paul, Minnesota trial calendar. Petitioner was an Ohio resident when he filed his petition, but he is a professional-football safety who signed a contract with the Indianapolis Colts in the fall. On January 7, 2022 we spoke with the parties after petitioner moved for a continuance. The Colts were, at the time of the call and despite their 9-7 record, not eliminated from the NFL playoffs. Mr. Sendejo's attorney has found it hard to reach him given his traveling schedule which, it seems, may continue for a bit. See esp. Buffalo Bills at 1992-1993 season (wild-card teams can even make the Super Bowl). Both parties think the case capable of settlement if petitioner cooperates in good faith in informal discovery. It is reasonable to give him some time to do so when his season reaches its end, and it is therefore

ORDERED that this case is stricken from the Court's March 22, 2022 trial calendar. It is also

ORDERED that this division of the Court retains jurisdiction. It is also

ORDERED that on or before March 7, 2022 the parties shall file a status report to describe their progress toward settlement, especially progress in completing informal discovery.
