ORDER


In submitting the proposed joint pretrial order, defendant has disregarded the Court's requirements by failing to specify the pages and lines of the depositions it proposes to offer, which has made it impossible for plaintiff to note any objections to those proffers.

Absent the filing, on or before January 30, 2004, of an amended joint pretrial order correcting this deficiency, defendant Bankers Trust Company will be foreclosed from reliance, either in dispositive motions or at trial, on any deposition testimony other than that previously designated by plaintiff. Defendant shall furnish its designations to counsel for plaintiff no later than January 27, 2004.

SO ORDERED.
