Sellitto v. Stone

District Court of Appeal of Florida, Fourth District
Dec 3, 1997
701 So. 2d 913 (Fla. Dist. Ct. App. 1997)

Opinion

Case No. 96-2324

Opinion filed December 3, 1997

Appeal from the Circuit Court for the Fifteenth Judicial Circuit, Palm Beach County; Edward Rodgers, Judge; L.T. Case No. CD 95-6808 FA.

Ronald E. D'Anna of Mattlin McClosky, Boca Raton, for appellant.

Matthew J. Schaefer of Matthew J. Schaefer, P.A., Ft. Lauderdale, for appellee.

We reverse the final judgment and remand in light of the former husband's entitlement to a continuance. Permitting withdrawal of his attorney very close to the trial date without a concomitant continuance effectively deprived appellant of the opportunity to be represented.

GLICKSTEIN, DELL and WARNER, JJ., concur.
