Sellingsloh v. Sellingsloh

Appellate Division of the Supreme Court of New York, First Department
Apr 18, 1947
272 App. Div. 761 (N.Y. App. Div. 1947)

Opinion

April 18, 1947.

Present — Martin, P.J., Glennon, Dore, Callahan and Peck, JJ.;

Determination of the Appellate Term affirmed, with costs and disbursements. No opinion.

The defendant failed to show any merit in his alleged defenses. His affidavit is too indefinite to create a triable issue. The determination should be reversed and the order and the judgment for plaintiff granted by the Municipal Court should be affirmed.
