MEMORANDUM OPINION


Before the Court is the parties' March 2, 2005 "agreed motion to dismiss and for remand." The motion states, "The parties have reached an agreement regarding the merits of this appeal, and, pursuant to that agreement, moved the Court to dismiss this appeal and to reverse and remand the case to the trial court for a new trial on the merits." The parties' motion is GRANTED to the extent the trial court's judgment of September 13, 2004 is VACATED, without reference to the merits, and the case is REMANDED to the trial court for further proceedings. See Tex.R.App.P. 42.1(a)(2).
