Jun 14, 1978
359 So. 2d 904 (Fla. Dist. Ct. App. 1978)

Opinion

No. 77-826.

June 14, 1978.

Appeal from Circuit Court, Broward County; W. Herbert Moriarty, Judge.

Jeffrey S. Altman and Chad P. Pugatch, of Goldberg, Young, Goldberg Borkson, P.A., Fort Lauderdale, for appellant.

Herbert A. Warren, Miami, for appellees.

Appellees sued for specific performance or in the alternative to recover their deposits on two condominium apartments. Appellees abandoned the count for specific performance and the trial court found for the appellees on the second count for restitution.

We have fully considered appellant's contentions but find on this record that the judgment appealed from should be affirmed.

AFFIRMED.

DOWNEY, C.J., ANSTEAD, J., and SILVERTOOTH, LYNN N., Associate Judge, concur.
