Appeal from a judgment (denominated order) of Supreme Court, Onondaga County (Murphy, J.), entered May 8, 2002, which, inter alia, declared that plaintiff must defend and indemnify defendant Hueber-Breuer Construction Co., Inc. in the underlying personal injury action.
