On order of the Court, the application for leave to appeal from the May 14, 2002 decision of the Court of Appeals is considered, and pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the judgment of the Court of Appeals and REMAND this case to the Court of Appeals for reconsideration in light of the decision of the special conflict panel in Adams v Dep't of Transportation, 253 Mich. App. 431 (2002) (No. 230268, October 11, 2002). The motion by The Michigan County Road Commission Self-Insurance Pool to file an amicus brief is also considered, and it is GRANTED. The motion by the Michigan Manufacturers' Association and the Michigan Self-Insurers' Association to file an amicus brief is also considered, and it is GRANTED.

Cavanagh and Kelly, JJ., would grant leave to appeal.
