In an action to recover damages for fraud, the appeal is from so much of an order as denies appellant's motion to dismiss the complaint on the ground that it fails to state facts sufficient to constitute a cause of action. Order affirmed, with $10 costs and disbursements. No opinion. Nolan, P.J., Murphy, Ughetta, Hallinan and Kleinfeld, JJ., concur.
