District Court of Appeal of Florida, First District
Dec 29, 2010
49 So. 3d 1289 (Fla. Dist. Ct. App. 2010)

Opinion

No. 1D10-5497.

December 29, 2010.

Petition for Writ of Mandamus — Original Jurisdiction.

Mark S. Spangler of the Law Offices of Mark S. Spangler, P.A., Maitland, for Petitioner.

David D. Hershel, Department of Financial Services, Division of Legal Services, Tallahassee, for Respondent.

Because the agency has issued an amended final order in the proceedings below, the petition for writ of mandamus is denied as moot. The agency's order constitutes a final disposition of the proceedings below, and petitioner's complaints concerning the adequacy and correctness of that order are matters properly ad dressed on plenary appeal.

BENTON, C.J., VAN NORTWICK and ROBERTS, JJ., concur.
