JUDGMENTS, § 5.1when summary judgment on notes is error. Under circumstances, held that plaintiff's motion for summary judgment on notes, made after confession judgment thereon had been opened, should have been denied and that defendant should have been allowed jury trial in accordance with her demand.

Appeal from the Municipal Court of Chicago; the Hon. THOMAS A. GREEN, Judge, presiding.

Judgment reversed and cause remanded with directions. Heard in the second division, first district, this court at the December term, 1942.
