ORDER GRANTING THE ELEVENTH INTERIM FEE APPLICATION OF THE RECEIVER AND HIS PROFESSIONALS AND AUTHORIZING PAYMENT THEREOF
THIS MATTER having been opened to the Court upon the Eleventh Interim Fee Application (the "Application") of Alan B. Handler, the Court appointed receiver (the "Receiver"), Wilentz, Goldman Spitzer, P.A. (the "Wilentz Firm"), counsel for the Receiver, and M K Rosenfarb LLC (the "Rosenfarb Firm"), accountants for the Receiver; seeking entry of an order granting the Receiver and said professionals an interim fee award for the period through and including October 31, 2008 (the "Eleventh Interim Fee Period"); and the Application further seeking authorization by the Court for the Receiver to pay such amounts as are sought in the Application; and the Court having reviewed the Application and the documents annexed thereto and submitted in conjunction therewith; and for good cause shown,
On or about June 1, 2008, RosenfarbWinters, LLC changed its name to M K Rosenfarb LLC.
IT IS on this 15th day of December, 2008,
ORDERED that, the following interim awards for fees and expenses be and hereby are granted for the Eleventh Interim Fee Period, which amount includes authority to pay all holdbacks under this Court's Administrative Order May 12, 2000, the following amounts:
(i) the Receiver and the Wilentz Firm — $67,051.50 for fees and costs of $4,429.21; and
(ii) the Rosenfarb Firm — $25,053.00 for fees and $280.06 for costs; and it is
FURTHER ORDERED that, a copy of this Order shall be served upon all parties in interest within seven (7) days of the submitting party's receipt of same.
