United States District Court, D. Utah
Dec 18, 2003
Case No. 2:02-CV-01199 TC (D. Utah Dec. 18, 2003)

Opinion

Case No. 2:02-CV-01199 TC

December 18, 2003

ORDER

Defendant Thomas Nelson objects, under Rule 72 of the Federal Rules of Civil Procedure and DUCivR 74-1, to United States Magistrate Judge David Nuffer's November 24, 2003 Order Granting [the SEC's] Motion for Clarification. Mr. Nelson objects to the Order on the grounds that it does not adequately prevent prejudice to Mr. Nelson's and to his clients who allegedly "have nothing to do with the Vavasseur program." (Objection at 5.)

The court has carefully considered both Mr. Nelson's objections and Judge Nuffer's Order, and finds that the latter is not clearly erroneous. As Mr. Nelson recognizes, Judge Nuffer's Order specifically imposes redaction requirements and limitations on use of unredacted documents "to prevent embarrassment and undue burden to the persons whose financial information is shown in the bank documents," where such documents are "not related to the purposes of this litigation." (November 24, 2003 Order at 2.) Judge Nuffer's Order is AFFIRMED.
