ORDER


For reasons stated on the record in open court this day,

1. The motion by Joseph F. Doody to dismiss the complaint is denied.

2. The motion by plaintiff for entry of a contested scheduling order is denied.

3. The time of Joseph F. Doody IV to answer or move with respect to the complaint is extended to and including February 6, 2002.
