We grant the petition and direct the trial court to reinstate relator's action against Palm Beach County. See Fischer v. Bartberger, 330 So.2d 507 (Fla. 4th DCA 1976) and Gonzalez v. Turner, 427 So.2d 1123 (Fla. 3d DCA 1983).
