Appeal from Court of Claims.

Present — Foster, P.J., Heffernan, Brewster, Deyo and Santry, JJ.


Appellant claims that the moving affidavits do not show a reasonable excuse for failure to file a claim within the statutory period. The order was discretionary with the court below and we cannot say that as a matter of law such discretion was abused. Order unanimously affirmed, with $10 costs.
