Scott v. State

COURT OF APPEALS OF THE STATE OF NEVADA
Oct 11, 2017
No. 74007 (Nev. App. Oct. 11, 2017)

Opinion

No. 74007

JEREMIAH SCOTT, Petitioner, v. THE STATE OF NEVADA, Respondent.

ORDER DENYING PETITION

This is an original petition for a writ of prohibition seeking an order directing the district court to immediately cease the prosecution against petitioner. Petitioner asserts the district court lacks jurisdiction because he was a juvenile when the alleged offense was committed. Petitioner has also filed an addendum to the petition, a "Request for Show Cause," and an assertion of his Fifth and Sixth Amendment rights.

We have considered the petition and all documents filed in this matter, and we are not satisfied this court's intervention by way of extraordinary writ is warranted at this time. See NRS 34.320; NRS 34.330; NRAP 21(b)(1); Pan v. Eighth Judicial Dist. Court, 120 Nev. 222, 228, 88 P.3d 840, 844 (2004) ("Petitioner[ ] carr[ies] the burden of demonstrating that extraordinary relief is warranted."). Accordingly, without deciding upon the merits of any claims raised, we

ORDER the petition DENIED.
