On February 16, 2017, this Court had dismissed this pro se appeal for want of jurisdiction as untimely. On June 28, 2017, the Court of Criminal Appeals reversed this Court's judgment after holding that the appellant's notice of appeal was timely filed, reinstated the appellant's appeal, and issued its mandate on July 24, 2017.
On August 9, 2017, a supplemental clerk's record was filed in this Court including, among other documents, the district court's order, signed on August 3, 2017, appointing Danny Easterling as counsel for appellant. The clerk's record was previously filed on November 30, 2016, but no reporter's record or briefs had been filed before this Court's opinion and judgment were issued. On August 15, 2017, the court reporter filed nine volumes of the reporter's record.
Accordingly, the Court sua sponte directs the Clerk of this Court to REINSTATE this case on the Court's active docket.
Appellant is ORDERED to file his appellate brief no later than September 14, 2017. See TEX. R. APP. P. 2, 38.6(a)(2), (d).
The State's appellate brief, if any, is ORDERED to be filed no later than 30 days from the filing of appellant's brief. See TEX. R. APP. P. 38.6(b).
