ORDER

The recommended disposition filed by Magistrate Judge Beth Deere has been reviewed, along with the objections filed by Willie Scott. After careful consideration and conducting a de novo review of the record, it is concluded that the recommended disposition should be, and hereby is, approved and adopted in its entirety in all respects. Scott's petition for writ of habeas corpus [Doc. No. 2] is dismissed without prejudice.

When entering a final order adverse to a habeas corpus petitioner, a certificate of appealability must be issued or denied. Rule 11, Rules Governing Section 2254 Cases. A certificate of appealability can be issued only if a petitioner has made a substantial showing of the denial of a constitutional right. 28 U.S.C. § 2253(c)(l)-(2). Mr. Scott has not provided a basis upon which to issue a certificate of appealability. Accordingly, a certificate of appealability is denied.
