ORDER

This case is currently calendared for trial during the Court's May 16, 2022, Helena, Montana, remote trial session. On April 22, 2022, respondent filed a Motion to Dismiss for Lack of Prosecution (Doc. 8). In the motion, respondent moves the Court to dismiss the case and find in its order that there is a deficiency in the amount of $10, 341.00 due from petitioner for the taxable year 2019, and that there is no penalty due from petitioner for the taxable year 2019 under the provisions of I.R.C. § 6662. Upon due consideration, it is hereby
ORDERED that, immediately upon receiving this order, but no later than May 9, 2022, petitioner shall telephone Karen Jones, Chambers Administrator of the undersigned judge, at (202) 521-0760, for the purpose of scheduling a pretrial telephone conference. It is further
ORDERED that, on or before May 9, 2022, petitioner shall serve on respondent and file with the Court a response to respondent's Motion to Dismiss for Lack of Prosecution. It is further
ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, filed April 22, 2022, is set for hearing at the Court's Helena, Montana, remote trial session scheduled to commence on May 16, 2022, at 10:00 a.m. Mountain Time. Petitioner is advised that failure to comply with the terms of this Order or failure to appear at the hearing on May 16, 2022, may result in the Court granting the relief sought in the motion.
The parties shall refer to the Notice Setting Case for Trial (Doc. 5) for the Zoomgov Meeting ID and Passcode.
This Order constitutes official notice to the parties.
