Steven L. Scott & Paula M. Scott Petitioners v. Commissioner of Internal Revenue Respondent

ORDER

Elizabeth A. Copeland, Judge

This case is calendared for trial at the Trial Session of the Court scheduled to commence on November 1, 2021, for cases where Houston, Texas is the place of Trial. On August 10, 2021, counsel for petitioners filed with the Court a Motion for Continuance.

On August 27, 2021, the Court held a telephonic conference with the parties to discuss the motion. This case has been continued six (6) times; first based a medical related request and the five (5) subsequent continuances because petitioners had been making monthly installment payments on the taxes, penalties, and interest at issue in this case to the point of nearly paying the full balance of the outstanding liabilities, which will resolve the case.

Petitioners' motion indicated that respondent's counsel did not object to the granting of the motion.

After due consideration, and for cause, it is

ORDERED that petitioners' Motion for Continuance, filed August 10, 2021, is granted in that this case is stricken for trial from the November 1, 2021, Houston, Texas trial calendar and this case is continued generally.
