ORDER


After making an independent review of the pleadings, files and records in this case, and the Findings, Conclusions and Recommendation of the United States Magistrate Judge, filed April 2, 2002, the court concludes that the findings and conclusions of the United States Magistrate Judge are correct, and they hereby are accepted as those of the court. Petitioner's writ of habeas corpus therefore is denied, and this action is dismissed without prejudice for want of prosecution pursuant to FED. R. CIV. P. 41(b).
