ORDER


Defendant Metro-North Railroad seeks to quash a notice of deposition served on behalf of Scientech, Inc. which seeks a Rule 30(b)(6) examination, principally for the purpose of exploring the adequacy of Metro-North's compliance with document requests insofar as they seek electronic materials.

Metro-North has shown no sufficient reason for precluding such a deposition. Scientech, however, should exercise good judgment in conducting any such examination. The Court will not tolerate a time consuming, expensive and wasteful fishing expedition; absent appropriate grounds to prolong the examination, the Court will not hesitate to impose sanctions shifting the cost to Scientech in the event the bonds of good judgment are exceeded.

SO ORDERED.
