OPINION

THE COURT.

It is ordered that the opinion filed herein on May 9, 2001, 88 Cal.App.4th 1329 106 Cal.Rptr.2d 523 be modified as follows.

At page 15, footnote11 [88 Cal.App.4th 1342, advance report, fn. 11,lines 2-3], the initial phrase of the second sentence: after the word "But" insert the words "there was no evidence" after the word "Schwartzes" delete the words "did not know" and insert therefor the word "knew."

The phrase shall now read: "But there was no evidence the Schwartzes knew."

This modification does not effect a change in judgment.

The petition for rehearing is denied.
