Judgment reversed upon the law, with costs, and complaint dismissed, with costs. The prior judgment entered in the action brought by the defendant in this action against this plaintiff determined the same issues as those raised in this action, and is, therefore, res adjudicata. Lazansky, P.J., Young, Hagarty, Seeger and Carswell, JJ., concur.
