Dec 10, 1951
279 App. Div. 755 (N.Y. App. Div. 1951)

Opinion

December 10, 1951.

Present — Nolan, P.J., Carswell, Johnston, Sneed and Wenzel, JJ.

The action is to recover damages for personal injuries suffered by plaintiff when he was a passenger in a bus owned and operated by defendant Liguori. At the time of the accident the bus was hired by, and operated in the service of, defendant Mountain Transit Corp. The jury rendered a verdict of $15,000 in favor of plaintiff against said defendants, and in favor of defendant Liguori on the cross complaint of defendant Mountain Transit Corp. Said defendants appeal from the judgment in favor of plaintiff entered on the verdict and, in addition, Mountain Transit Corp. appeals from so much of the judgment as dismisses its cross complaint against Liguori. Judgment unanimously affirmed, with costs. No opinion.
