Delivered and Filed: March 17, 2004.

Appeal from the County Court at Law No. 7, Bexar County, Texas, Trial Court No. 264568, Honorable Timothy F. Johnson, Judge Presiding.

Agreed Motion to Reverse Granted; Reversed and Remanded Pursuant to Settlement Agreement.

MEMORANDUM OPINION

Appellants filed a motion to dismiss this appeal stating that the parties have reached a settlement. Appellants request that we reverse and render judgment in conformity with their settlement agreement; however, the terms of the agreement are not sufficiently stated in the motion or attached Rule 11 agreement to permit this court to render judgment. Accordingly, at the parties' request we reverse the trial court's judgment without regard to the merits and remand the case to the trial court for rendition of judgment in accordance with the parties' settlement agreement. See 42.1(a)(2)(B). Costs of the appeal are taxed against the party incurring the cost.
