APPEAL — Review — Overruling Motion for New Trial — Absence of Exception to Ruling. — Where the only error assigned was the overruling of the motion for a new trial and no exception to such ruling, the judgment must be affirmed.

From LaPorte Circuit Court; Alfred J. Link, Judge.

Action by Frederick Schultz and Charles Schultz against John S. Vanderbye and another. From a judgment for defendants, the plaintiffs appealed. Affirmed. By the court in banc.

The only error assigned is the overruling of the motion for a new trial. No exception having been taken to such ruling, the judgment is affirmed.
