The petition for writ of mandamus is denied without prejudice to the petitioner to file an appropriate pleading in the circuit court in the county in which his prison is located. See § 79.09, Fla. Stat. (2013) ; Van Povck v. Dugqer. 579 So. 2d 346, 347 (Fla. 1st DCA 1991).
