Schoonmaker v. State

Appellate Division of the Supreme Court of New York, Third Department
Jun 20, 1967
28 A.D.2d 771 (N.Y. App. Div. 1967)

Opinion

June 20, 1967

In our previous decision the determination of the cross appeals herein was withheld and the case remitted for new or additional findings ( 27 A.D.2d 960). The new findings disclose separate and appropriate treatment for the parcels which had different uses and different values. Claimant took a cross appeal but in her brief seeks only the affirmance of the judgment. We have examined the remaining contentions of the parties and upon the record before us, find no basis for disturbing the award. Judgment affirmed, with costs. Gibson, P.J., Herlihy, Aulisi, Staley, Jr., and Gabrielli, JJ., concur in memorandum by Aulisi, J.
