Schneider v. Schneider

Appellate Division of the Supreme Court of the State of New York
May 26, 2016
2016 N.Y. Slip Op. 75600 (N.Y. App. Div. 2016)

Opinion

05-26-2016

In the Matter of ERIC SCHNEIDER, a Suspended Attorney COMMITTEE ON PROFESSIONAL STANDARDS, Petitioner; v. ERIC SCHNEIDER, Respondent.

DECISION AND ORDER ON MOTION (Attorney Registration No. 2431633)

Motion by respondent, returnable May 9, 2016, for reargument of this Court's order, entered April 14, 2016, which granted petitioner's motion to vacate the stay of respondent's suspension and suspend him from the practice of law for two years (138 AD3d 1307, ___ [2016], 2016 NY Slip Op 02899, *1 [Apr. 14, 2016]).

We find that respondent has not demonstrated that this Court "'overlooked or misapprehended the relevant facts, or misapplied any controlling principle of law'" (Adderley v State of New York, 35 AD3d 1043, 1043-1044 [2006], quoting Foley v Roche, 68 AD2d 558, 567; see Matter of Dambrowski v Dambrowski, 8 AD3d 913, 915-915 [2004]) and, therefore, we deny his motion.

Accordingly, upon the papers filed in support of the motion, and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.

Lahtinen, J.P., McCarthy, Egan Jr., Lynch and Clark, JJ., concur.
