Schmid v. Doerrer

Appellate Court of Connecticut
Dec 3, 1991
599 A.2d 404 (Conn. App. Ct. 1991)

Opinion

(9858)

Argued November 7, 1991

Decision released December 3, 1991

Action, in the first case, to quiet title to certain real property, and for other relief, and action, in the second case, to enjoin the defendants from maintaining a septic system on that property, brought to the Superior Court in the judicial district of Middlesex, where the cases were consolidated and referred to Gregory M. Harris, attorney state trial referee, who filed a report recommending judgment, in the first case, settling title to the subject property in the plaintiffs' and granting certain other relief, and recommending judgment for the defendants in the second case; thereafter, the court, Harry W. Edelberg, state trial referee, rendered judgment in each case in accordance with the referee's recommendation, and the defendants in the first case, the plaintiffs in the second case, appealed to this court. Affirmed.

Geraldine Battistoli, for the appellants (defendants in the first case, plaintiffs in the second case).

Edward S. Domnarski, Jr., for the appellees (plaintiffs in the first case, defendants in the second case).

Our review of the record, briefs and oral argument convinces us that the conclusions reached by the attorney trial referee and accepted by the trial court are more than adequately supported by the subordinate facts found. Clark v. Drska, 1 Conn. App. 481, 484-85, 473 A.2d 325 (1984).
