PHILLIP R. SCHLITTLER, INDIVIDUALLY AND AS INDEPENDENT EXECUTOR OF THE ESTATE OF CHARLES A. TISDALE, Appellant v. THE ESTATE OF ADRIAN F. MEYER, Appellee

On Appeal from the County Court at Law Austin County, Texas
Trial Court Cause No. 14PR-9813

ORDER

Appellee filed a motion to dismiss for lack of jurisdiction. On June 13, 2017, we abated this appeal for the trial court to clarify its intent with respect to finality and the parties to obtain a final judgment if necessary. A supplemental clerk's record with a final judgment signed June 27, 2017, was filed on July 6, 2017.

We reinstate the appeal and deny appellee's motion to dismiss. Appellant's notice of appeal, prematurely filed on January 20, 2017, is deemed to have been filed on June 27, 2017. See Tex. R. App. P. 27.1(a).

The record on appeal is complete. Appellant's brief is due August 14, 2017.
