Ronald L. Buch, Judge.

On May 22, 2020, the Commissioner filed a Motion for Summary Judgment. Two months later, Mr. Schlapfer filed a Cross-Motion for Summary Judgment. Those motions remain pending.

On April 18, 2022, the Court held a conference call with the parties during which Mr. Schlapfer's counsel requested the opportunity to supplement his client's pending motion. The Commissioner did not object and requested an opportunity to respond to any supplement that might be filed. Accordingly, it is hereby

ORDERED that Petitioner shall file any supplement to his pending Cross-Motion for Summary Judgment by April 28, 2023. It is further

ORDERED that the Commissioner may file a response to Petitioner's Supplement to his Cross-Motion for Summary Judgment by May 19, 2023.
