ORDER

This case was called at the Court's May 17, 2021, Buffalo, New York, remote trial session, and jurisdiction was retained by the undersigned. Petitioner Craig Schieder did not appear. Respondent's counsel appeared and filed a motion to dismiss for failure to properly prosecute. The Court issued an Order to Show Cause on May 21, 2021, as to why the motion to dismiss should not be granted. On June 16, 2021, Mr. Schieder filed a response to our Order to Show Cause. Given the response, we will give Mr. Schieder one more chance to appear for trial.
The Court will add this case to its September 20, 2021, remote trial session, where San Diego, California is listed as the place of trial. Because all trial sessions are being conducted remotely, this place of trial is for administrative purposes only.
Upon due consideration, it is
ORDERED that the Court's Order to Show Cause served May 21, 2021, is discharged. It is further
ORDERED that respondent's motion to dismiss for failure to properly prosecute, filed May 17, 2021, is denied without prejudice. It is further
ORDERED that this case is calendared for trial during the Court's September 20, 2021, San Diego, California, trial session to be conducted remotely, which is scheduled to begin 10:00 a.m. (Pacific Time)/1:00 p.m. (Eastern Time). It is further
ORDERED that the Clerk of the Court shall also serve on the parties: (1) a Notice of Remote Proceeding that shall contain comprehensive instructions on how to participate in the Court's September 20, 2021, San Diego, California, trial session, (2) a copy of the Standing Pretrial Order for the Court's September 20, 2021, San Diego, California, remote trial session, and (3) a clinic letter for Buffalo, New York.
