ORDER

L. Paige Marvel, Judge.

This case is calendared for trial at the New York City, New York, Trial Session of the Court that is scheduled to begin on February 27, 2023. On February 6, 2023, respondent filed a status report stating, among other things, that petitioner Bradley J. Scher died subsequent to the filing of the petition to commence this case. Respondent further states that the parties have reached a settlement for all items at issue. Because of the recitals contained in respondent's status report, the Court will continue this case to allow counsel for respondent to determine whether a Nordstrom motion or a motion to substitute party should be filed. Accordingly, and for cause, it is

ORDERED that this case is stricken for trial from the Court's February 27, 2023, New York City, New York, Trial Session and is continued. It is further

ORDERED that jurisdiction of this case is retained by the undersigned. It is further

ORDERED that on or before March 23, 2023, respondent shall file a report as to the then-present status of this case.
