ORDER MODIFYING OPINION, DENYING PETITION FOR REHEARING [No Change in Judgment]

McCONNELL, P. J.

THE COURT:

It is ordered that the opinion filed herein on July 13, 2009, be modified as follows.

1. On page 3, first paragraph, the sentence that begins with "Dr. Schatz quit paying legal fees shortly before trial" is revised to read:

"Dr. Schatz quit paying legal fees in May 2003 because he claimed Allen Matkins had a conflict of interest."

2. On page 3, first paragraph, second to the last sentence, beginning with the words "Dr. Schatz, however," is deleted and replaced with:

"Allen Matkins tried the case on his behalf and obtained a favorable result."

3. On page 3, the first full paragraph, after the third sentence ("He exercised his right under the MFAA"), the fourth and remaining sentences in that paragraph are deleted.

The petition for rehearing is denied.

There is no change in the judgment.
