EITAM SCHARF, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER OF DISMISSAL FOR LACK OF JURISDICTION

Kathleen Kerrigan Chief Judge

By Order issued December 21, 2022, the Court directed petitioner to file a Ratification of Petition. On February 27, 2023, the Court received from petitioner a Letter Dated February 15, 2023, in which petitioner states that this matter has been resolved with the IRS and indicates that petitioner does not wish to continue to prosecute this case. Petitioner's letter suggests that petitioner does not intend to file a Ratification of Petition.

Upon due consideration of the foregoing, it is

ORDERED that this case is dismissed for lack of jurisdiction on the grounds that petitioner failed to ratify the petition filed to commence this case.
